Substituted Service
The are many couples around South Africa that drift apart without ever getting divorced, This usually happens when couple never bother to keep in contact after separation after either of them starts thinking about remarriage or buying property. If your Spouse cannot be divorce to properly serve them with summons, you may divorce through substituted service.
The Process
This service is allowed only when the Plaintiff cannot identify the whereabouts of the defendant. This service is only allowed only when an application is sort and granted at Court for a substituted service to be made. This is done by an Affidavit indicating all the necessary steps taken by the Plaintiff to find and locate the Defendant unsuccessfully.
This information will show the Court that the missing spouse can’t be served with the summons personally using the sheriff therefore you’re entitled to obtain leave for substituted service. If the Court does grant your request, the court will order the method of service it deems necessary, such as publication in the newspaper and service to family members or friends.
